Short answer

Transferability must be assessed for the specific rights and applicable terms. BitMart’s published user agreement contains an assignment restriction. A purchase agreement between two parties does not, by itself, establish that BitMart or another process will recognise a transfer.

Identify the rights and the account holder

Start with the person or company named on the account, the relevant contracting entity and the account terms. Identify what the sale would cover: rights relating to a balance, a disputed withdrawal or later distributions. Avoid a description as vague as “the account”.

Tell the reviewer if a representative is acting, if ownership is disputed, or if rights were previously sold or pledged. A person able to send an email may not have authority to sign.

Read the assignment clause in context

Section 9.2 of the published BitMart agreement restricts assignment by users. The effect on a proposed transaction depends on the particular rights, contract and applicable law. Do not assume the restriction can be ignored or that using another deal label resolves it.

List the conditions for recognition and payment

Before proceeding, clarify whether consent, notice, acknowledgement or another formal step is needed. Establish who handles each step and what happens if it is not obtained. Contract signing, recognition of a transfer and payment can occur at different times.

  • Correct seller and signing authority
  • Exact scope of rights transferred
  • Required consents or notices
  • Treatment of payments to the old account
  • A clear outcome if closing cannot happen

Keep account credentials outside the sale

A claim sale should be documented as a rights transaction, not treated as a request to hand over a password or seed phrase. Our initial enquiry does not require control of your account.

Get case-specific legal advice before signing where the effect of the restriction or your obligations is unclear. This article describes review questions; it does not determine that your rights can be transferred.
